These are the terms and conditions for the website LoriPoncsakArt.com Please read these terms carefully. By purchasing our products or otherwise using our website, you are agreeing to be legally bound by said terms. These terms include – but are not limited to – the following:
Authenticity
All of our items are 100% guaranteed authentic. Lori Poncsak Art invoices shall act as a de facto certificate of authenticity, should one be needed.
Condition
Please bear in mind that our items are hand made including many of the frames. They may not be in flawless condition. Please view photos carefully and read complete product descriptions. If you would like additional condition details or photos, please contact us. All items are sold on an “as is” basis, and while we do our best to provide clear photos and accurate condition details, some condition issues and/or restoration details may not be explicitly described and/or visible in photos. As a rule, we will indicate if an item has noteworthy condition issues or has undergone significant restoration work.
Ordering
By submitting an order to purchase products, you are entering into a binding contract to purchase said products for the price shown on the the website, along with any applicable taxes, customs duties and shipping fees. As most of our products are one-of-a-kind and as such subject to prior sale, we cannot guarantee that each item ordered will be available at the time of purchase. In such cases, Lori Poncsak Art will notify you immediately and refund the total sum of any payments authorized or made, but we will not be obliged to offer any additional compensation.
Prices
All prices shown are in U.S. dollars. If you are paying in another currency, we recommend that you check current rates of exchange to get the most accurate estimate of the final charge amount. Buyers paying in foreign currency agree to bear the risk of fluctuations in exchange rates and are responsible for the full price in U.S. dollars as dictated by currency exchange markets at time of purchase. Please also be aware that many banks charge an additional fee for credit card payments made in another currency; this amount (typically 2-4%) is the responsibility of you, the purchaser.
If the price of any item has been incorrectly listed, we reserve the right to cancel the sale. In such instances, we will immediately issue a refund. We will not be obliged to offer any additional compensation.
Shipping
We will ship items within three days of receiving payment. Standard shipping includes USPS Priority Mail, UPS and FedEx Ground/Home Delivery. Expedited shipping within the USA is available, but not complementary. Please note that FedEx does not ship to P.O. Boxes – a street address is required.
For shipping outside the continental U.S., we will calculate and charge actual shipping costs to include customs fees, and an online invoice is required for approval. Please note that we do not charge for “handling”, packing materials etc. Delivery timeframes are estimates and delivery dates cannot always be guaranteed. Customs issues, acts of God, carrier/postal bureau performance and seasonal/holiday issues may cause delays.
Taxes & Customs Duties
Delivery charges do not include any taxes, import duties, customs charges or similar fees. California buyers agree to pay California state sales tax. Overseas buyers assume responsibility for any and all import duties and/or customs fees. Please be aware that said fees can vary a great deal from territory to territory, and may be significant. We have no control over such fees and are in no way responsible for paying them. In the event that a customer refuses to accept a shipment due to issues stemming from customs fees, the customer will be responsible for any and all shipping charges incurred in the shipment and return shipment of the item(s)

When making a purchase, all information – including your name, address and credit card information – is encrypted using SSL (Secure Socket Layering) technology and transmitted over and stored on Secure Servers for maximum protection. Neither we nor our credit card processing company retain, share, store, or use personally identifiable information for any secondary purposes. We do not store PIN data or security codes.
If you have signed up for our newsletter or opted to receive it, you will receive our email updates, which we send out on a monthly basis. We may also occasionally send an additional email during the course of a month, but we will not send any more than two per month. You may easily opt-out of the newsletter at any time.
